Terms of service

Last updated: 9 October 2026

OVERVIEW

Welcome to Abu Qumash. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Abu Qumash Group Ltd.

Abu Qumash Group Ltd operates this website and store, including all related information, content, features, tools, products and services (the “Services”). Our Services are powered by Shopify, which enables us to offer our products and services to customers.

These Terms of Service, together with the policies referred to in them, explain the terms on which you may access and use our Services and purchase products from us.

Please read these Terms carefully before using our Services. They explain important information about your rights and responsibilities.

By accessing or using our Services, you agree to these Terms, subject to your statutory rights under applicable law. If you do not agree to these Terms, please do not use our Services.

Nothing in these Terms excludes or limits any consumer rights that cannot lawfully be excluded or limited under applicable law.

SECTION 1 — ACCESS AND ACCOUNT

You must be legally capable of entering into a binding contract to purchase products from us.

When using our Services, you may be asked to provide information such as your name, email address, billing address, delivery address and payment details. You agree that the information you provide is accurate, complete and up to date.

You are responsible for keeping your account login details secure and for activity carried out through your account, subject to any rights you may have under applicable law.

You must not sell, transfer or assign your account to another person without our prior written consent.

We reserve the right to suspend or restrict access to our Services where reasonably necessary, including where we suspect fraud, unlawful activity or a breach of these Terms. Any such action will be subject to applicable law.

SECTION 2 — OUR PRODUCTS

Abu Qumash offers modest clothing, including abayas, jilbabs, khimars and niqabs, as well as accessories, Islamic books and other products.

We aim to represent our products as accurately as possible through product descriptions, photographs and other information displayed on our website and sales channels.

Colours and appearances may vary slightly depending on your screen, device settings, lighting and the characteristics of the materials used.

We will make reasonable efforts to ensure that product descriptions, measurements, materials and other specifications are accurate. If a product is not as described, not of satisfactory quality or not fit for its intended purpose where required by law, your statutory rights will apply.

We may update product descriptions, discontinue products or change the availability of products from time to time. Changes will not affect an order that we have already accepted, except where permitted by law or agreed with you.

SECTION 3 — ORDERS AND CONTRACT FORMATION

You may purchase our products through our website, social media or direct-message ordering arrangements, and in our physical shop.

When you place an order, you are making an offer to purchase the selected products.

An automated order acknowledgement does not necessarily mean that your order has been accepted. A contract is formed when we confirm acceptance of your order, subject to applicable law.

We reserve the right to decline or cancel an order where there is a legitimate reason, such as a product being unavailable, a pricing error, suspected fraudulent activity or an inability to process payment. Where payment has been taken for an order that we do not fulfil, we will arrange an appropriate refund.

You should check your order carefully before submitting it. If you notice an error, please contact us as soon as possible.

You may request cancellation before dispatch. We will consider such requests promptly, but a request made after dispatch may need to be handled under the applicable cancellation and returns rules. Nothing in this section removes any statutory cancellation rights.

Our products are intended for personal or household use unless otherwise agreed. Any restrictions on commercial resale must be applied consistently with applicable law.

SECTION 4 — PRICES AND PAYMENT

All prices displayed on our website are in pounds sterling (GBP), unless expressly stated otherwise.

Product prices, delivery charges and any other applicable charges will be displayed or communicated before you complete your purchase.

We may change prices, discounts or promotions from time to time. The price applicable to your order will be the price agreed when the order is placed, subject to any genuine error handled in accordance with applicable law.

Payment must be made using the payment methods available at checkout or otherwise agreed with us for orders placed through other sales channels.

Where a pricing or listing error occurs, we will take reasonable steps to contact affected customers and resolve the matter fairly. We will not rely on this provision to disregard an existing contract or any consumer rights.

Any applicable taxes and charges will be disclosed as required by law. International customers may be responsible for additional import charges where applicable and where this has been properly disclosed before purchase.

SECTION 5 — SHIPPING AND DELIVERY

We deliver within the United Kingdom and internationally to destinations available through our sales channels.

Delivery options, charges and estimated delivery times will be communicated at checkout or before an order is confirmed through another sales channel.

Dispatch times may vary according to stock availability and operational circumstances. Where a specific delivery date or timeframe has been agreed, we will honour it subject to applicable law.

Unless otherwise agreed, goods must be delivered within the period required by applicable law.

Delivery dates are estimates unless expressly agreed otherwise. If a delivery is delayed, please contact us so that we can investigate and provide an update.

We may use third-party couriers and delivery services. However, using a courier does not remove our legal responsibilities to you. We will assist in investigating missing or delayed parcels and will deal with the matter in accordance with applicable law.

For consumer orders, responsibility for goods generally remains with us until the goods come into your physical possession or the possession of a recipient you have nominated, unless a lawful exception applies.

International deliveries may be subject to customs inspections, import duties, taxes and other charges imposed by the destination country. Responsibility for these charges must be made clear before purchase. Any applicable international delivery and customs arrangements will be communicated before you place your order.

SECTION 6 — RETURNS, CANCELLATIONS AND REFUNDS

6.1 Online orders

For eligible online purchases, you generally have the legal right to cancel within 14 days after the day you receive the goods, without giving a reason.

If you wish to cancel, you must clearly inform us of your decision within the applicable cancellation period. You must then return the goods within 14 days after notifying us of cancellation.

You may use our contact email address to notify us of cancellation. You may also use any applicable standard cancellation form provided with your order.

6.2 Condition of returned goods

You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, as you would when examining them in a shop.

You may be responsible for a reduction in the value of goods resulting from handling beyond what is necessary to examine them, where permitted by law.

Goods should be returned with their original packaging, accessories and labels where reasonably possible. However, a lack of original packaging will not automatically remove any statutory rights you have.

6.3 Return postage

For change-of-mind cancellations, customers are responsible for the direct cost of returning goods where this has been communicated before purchase and applicable law permits it.

Where goods are faulty, damaged, misdescribed or otherwise fail to meet the requirements of applicable law, we will handle return costs and remedies in accordance with your statutory rights.

6.4 Refunds

Where you validly cancel an online order under the statutory cancellation rules, we will issue the required refund within the applicable legal timeframe.

We may withhold a refund until we receive the returned goods or evidence that they have been sent back, whichever occurs first, where permitted by law.

Refunds will generally be made using the original payment method unless otherwise agreed with you. We will not charge a refund administration fee where prohibited by law.

For eligible statutory cancellations, the refund will include the cost of the least expensive standard delivery option we offered, where required by law. Additional charges for a more expensive delivery option may not be refundable.

6.5 Faulty or misdescribed goods

Nothing in this policy affects your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Depending on the circumstances, your rights may include a short-term right to reject faulty goods, repair or replacement, or a price reduction or refund.

Please contact us if an item arrives damaged, faulty or materially different from its description.

6.6 Niqabs and hygiene-sensitive products

For hygiene reasons, niqabs and gloves are non-returnable and non-exchangeable for change-of-mind reasons, including where a customer has ordered the wrong size, colour or style, or has simply changed their mind.

This policy does not affect your statutory rights. If a niqab or pair of gloves is faulty, damaged, misdescribed or otherwise fails to meet the requirements of applicable law, you may be entitled to a repair, replacement, refund or other remedy in accordance with your legal rights.

6.7 Purchases made in our physical shop

The statutory 14-day online cancellation right does not generally apply to ordinary purchases made in person at our shop.

Our change-of-mind returns and exchanges policy for in-store purchases will be communicated separately. Any voluntary returns policy we offer will not affect your statutory rights concerning faulty or misdescribed goods.

SECTION 7 — OPTIONAL THIRD-PARTY TOOLS

Our Services may include tools or features provided by third parties.

Where these tools are made available, their use may be subject to the third party's own terms and conditions.

We do not control every third-party tool and cannot guarantee its availability at all times. However, nothing in this section excludes any responsibility that we cannot lawfully exclude.

We may introduce additional features or tools in the future. These will be subject to these Terms and any additional terms notified to you.

SECTION 8 — THIRD-PARTY LINKS

Our Services may contain links to websites, platforms or services operated by third parties.

These links are provided for convenience. We do not control the content or policies of third-party websites and are not responsible for their independent practices.

If you visit or use a third-party website, you should review its terms and privacy policy.

Nothing in this section affects any rights or remedies you may have against us under applicable law.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Abu Qumash Group Ltd uses Shopify to operate and provide its online store.

Purchases made through our store are transactions between you and Abu Qumash Group Ltd, rather than purchases made directly from Shopify.

Shopify provides the platform and associated services that enable us to operate our store. Its own services may be subject to separate terms.

Nothing in these Terms releases Shopify or Abu Qumash Group Ltd from any liability that cannot lawfully be excluded or limits your statutory rights against the relevant party.

SECTION 10 — PRIVACY AND PERSONAL INFORMATION

We collect and process personal information in connection with your use of our Services, purchases, deliveries and customer enquiries.

Our handling of personal information is explained in our Privacy Policy, which should be read alongside these Terms.

Shopify and other service providers may process information on our behalf or as otherwise described in our Privacy Policy. Information may be transferred internationally where permitted by applicable data protection law.

We will process personal information in accordance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018 where applicable.

Our Privacy Policy must be accessible through our website and should explain how personal information is collected, used, shared and retained.

SECTION 11 — CUSTOMER FEEDBACK AND REVIEWS

If you submit a review, suggestion, comment or other feedback to us, you confirm that you have the right to provide it and that it does not unlawfully infringe another person's rights.

You grant Abu Qumash Group Ltd permission to use, reproduce and display your feedback for purposes connected with our business, including displaying customer reviews and improving or promoting our Services, subject to applicable law.

We will not treat this provision as permission to use personal information in a manner that breaches our Privacy Policy or applicable data protection law.

We may moderate or remove feedback that is unlawful, fraudulent, abusive, misleading or otherwise inappropriate, where permitted by law.

We are not obliged to publish every review or respond to every suggestion.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges or availability.

We reserve the right to correct errors and update information.

Where an error affects an order already placed, we will contact the customer where appropriate and resolve the issue in accordance with applicable law. We will not use this provision to cancel a binding contract without a lawful basis.

SECTION 13 — PROHIBITED USES

You may use our Services only for lawful purposes.

You must not use our Services:

  • For fraudulent or unlawful activity.

  • To infringe our intellectual property rights or those of another person.

  • To submit false, misleading, abusive or defamatory material.

  • To transmit malware, viruses or other harmful code.

  • To interfere with the security or operation of our website.

  • To collect or misuse other customers' personal information without lawful authority.

  • To access, scrape or reproduce website content in a manner that breaches these Terms or applicable law.

  • To impersonate another person or misrepresent your identity.

We may restrict or suspend access where we reasonably believe these Terms have been breached, subject to applicable law.

Nothing in this section prevents any use permitted by law.

SECTION 14 — TERMINATION AND SUSPENSION

We may suspend or terminate your access to all or part of our Services where reasonably necessary, including for fraud, unlawful conduct, security concerns or a material breach of these Terms.

Where appropriate and legally required, we will provide notice or an opportunity to resolve the issue.

Termination does not affect rights, obligations or remedies that arose before termination, nor does it remove any consumer rights that continue to apply.

Provisions that are intended by their nature to continue after termination will remain effective to the extent permitted by law.

SECTION 15 — INFORMATION AND PRODUCT WARRANTIES

We aim to ensure that the information provided through our Services is accurate and useful.

Our products are supplied subject to the rights and protections provided by applicable law, including statutory requirements concerning satisfactory quality, fitness for purpose and conformity with their description.

We do not guarantee that our website will always be available without interruption or error. Temporary interruptions may occur due to maintenance, technical issues or circumstances beyond our reasonable control.

Nothing in these Terms excludes or restricts any warranty, guarantee, representation or statutory right that cannot lawfully be excluded or restricted.

SECTION 16 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

We remain responsible for fulfilling our contractual obligations and complying with applicable consumer protection law.

Subject to the above, we will not be liable for losses that are not reasonably foreseeable consequences of our breach or other wrongdoing, to the extent permitted by law.

This section does not affect any rights or remedies you have under applicable law.

SECTION 17 — INDEMNIFICATION

If you use our Services unlawfully or breach these Terms in a manner that causes us to suffer loss or incur a third-party claim, you may be responsible for losses that are legally recoverable from you.

Nothing in this section creates liability where it would be unlawful, imposes an unfair term on a consumer or removes any statutory protection.

SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or severed to the extent necessary, where permitted by law.

The remaining provisions will continue to apply to the extent they remain valid and enforceable.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated into them and the terms agreed for an individual order, form the agreement governing your use of our Services and purchases from us.

If there is a conflict between these Terms and a specific term agreed for an order, the matter will be interpreted in accordance with the agreement and applicable law.

Our failure to enforce a provision immediately does not necessarily mean that we waive our right to enforce it later.

Nothing in this section excludes any representation, remedy or right that cannot lawfully be excluded.

SECTION 20 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms to another person without our prior written consent, except where permitted by law.

We may transfer our rights and obligations where legally permitted, provided that doing so does not reduce your rights or protections under applicable law.

SECTION 21 — GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rules that apply to you.

If you are a consumer residing in another part of the United Kingdom or another country, you may also benefit from mandatory rights and protections under the laws applicable to your circumstances.

Nothing in these Terms prevents you from bringing proceedings in a court that has jurisdiction under applicable law.

SECTION 22 — HEADINGS

The headings in these Terms are included for convenience only and do not affect the interpretation of the provisions.

SECTION 23 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services or legal obligations.

The latest version will be published on this page with its updated revision date.

Changes will not retrospectively remove rights already acquired under an existing contract. Where required, we will notify customers of material changes and obtain any necessary agreement.

Your use of our Services after an update does not override any legal requirement for express consent or notification.
